What information does Leyland collect?

The information we collect depends on how you use the Site. 

Information You Provide Us.  We collect personal information (e.g., name, address, telephone number, e-mail address, payment card information) that you knowingly provide when you:

For example, when you place an order for products using Site, we collect information such as your name, e-mail address, billing address, phone number, and payment card information to enable us to process and fulfill your order and contact you if we have any questions.  Also, in order to view the content on the Site, you will have to create an account with Leyland by providing your email address.  You may provide us with preferences such as products you may be interested in.  In any case, we’ll use the information you provide to us to make your shopping more efficient and to better serve your interests.

Now and then, we may conduct surveys, contests, sweepstakes, mailings or other promotions. If you choose to participate, we may request personal information such as your name, e-mail address, telephone number, shopping habits, interests and other information to enable us to execute the promotion and notify winners.  Some of this information will be mandatory to participate in the promotion; other information will be optional.  We will tell you whether any information is mandatory or optional.

This Privacy Policy covers only our use of cookies, web beacons, and other similar technology, and not the use of such technology by third parties.  Similarly, this Privacy Policy does not apply to third party websites accessed via hyperlinks within the Site.

How does Leyland use the information it collects?

We use your information in a manner consist with this Privacy Policy to:

  • process and fulfill your orders
  • help us improve our products and services
  • communicate with you and respond to your inquiries
  • maintain and service your Leyland accounts
  • maintain and improve the Site
  • process payments
  • evaluate your application for employment

Employment Information. We may enable your use of this Site to search for job openings at Leyland and to submit a job application. When you use this Site to apply for a job, you will be asked to provide certain personal information, such as your name, address, telephone number, email address, educational background and employment history. You may also send us your résumé and other information relating to your job search or application. We use this information only for recruiting and employment purposes; we do not use it for marketing purposes. If you are hired by Leyland, the information you provide during the recruiting process will become part of our employee records.

Does Leyland share your information with third parties?

We don’t sell or otherwise disclose the information we collect except, as described in this Privacy Policy, with your consent, or as otherwise disclosed when you provide the information.  We may share your information with our third party service providers to help us manage and operate the Site, process and fulfill your orders, process payments, perform statistical analysis, send you e-mail, postal mail or text messages, provide customer support and perform other important services. 

Unless you have given us your permission to do so, we will not share your personal information with unaffiliated third parties to enable those third parties to offer you products or services or otherwise market or promote such product or services.  However, we may partner with third parties to help us collect and aggregate certain information collected at the Site. If you select an alternative means of payment for any order (e.g., PayPal, Apple Pay or another form of alternate payment), you provide the personal and financial information needed to process your application or purchase directly to each provider associated with processing the payment.  The companies that administer these programs are independent of Leyland and have their own privacy policies. 

We and our third party service providers may disclose personal information if we or they reasonably believe that it is necessary to: (i) investigate any suspected misuse of the Site; (ii) comply with applicable federal, state or local laws, rules, regulations or orders; (iii) to protect or defend the rights, property and interests of Leyland, our customers, or the interests of our third party service providers; or (iv) under exigent circumstances, to protect the personal safety of users of the Site or the public.

Your information will be held by us for so long as is necessary for the purposes for which it was collected, for the settlement of any potential disputes that may be raised or otherwise in accordance with legal requirements.

We may share your information in connection with any corporate transaction, including any merger, consolidation, restructuring, the sale of stock, assets or both, or other corporate change or financing transaction, including whether made during the course of any due diligence process or otherwise.

How can you unsubscribe or change your information? 

We want to communicate with you only if you want to hear from us.  If you prefer not to receive information from us or would like to update or change your personal information or preferences, please, you can edit or delete your information by updating your account at the “My Account” tab on the Site. You may also send your request to us via the points of contact listed at the end of this Privacy Policy.  Please provide your full name, address, and email address so that we can locate you.  We will respond to your request within a reasonable period of time.  To unsubscribe from an e-mail list, please follow the instructions in any e-mail you receive.

What security measures does Leyland use to protect your information?

We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information.  Although we implement security measures designed to protect your information from unauthorized access, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by a breach.  By using our website, you acknowledge that you understand and agree to assume these risks.

Children

Access to and use of the Site is made available only to people who can form legally binding agreements under applicable law. The Site is intended for a general audience and is not intended to be used by minor children. Leyland does not knowingly collect personal information from minor children.  Children accessing the Site should obtain the permission and assistance of a parent or legal guardian. If you allow your minor child or a child for whom you are a legal guardian (a "Minor"), to access the Site, you will be solely responsible for: (i) the online conduct of such Minor; (ii) monitoring such Minor's access to and use of the Site; and (iii) the consequences of any use of the Site by such Minor.  Pursuant to Title 47 U.S.C. § 230(d) as amended, we hereby notify you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to material and information that is harmful to minors. Governing Law

This Privacy Policy will be governed by and construed in accordance with the laws of the State of Maine, without giving effect to its conflicts of law provisions. By accessing or using the Site, you consent and submit to the exclusive jurisdiction and venue of the state and federal courts located in Maine.  A printed version of this Privacy Policy will be admissible in judicial and administrative proceedings based upon or relating to this Privacy Policy to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

California Residents

California Civil Code Section 1798.83 permits Site users who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge.

Do Not Track

Some web browsers offer a “Do Not Track” setting.  However, there is currently no industry standard regarding the meaning of “Do Not Track” and what, if anything, websites should do in response.  As a result, we may not respond to “Do No Track” signals.

We may interact with you via a variety of social media platforms, including Facebook, Twitter and Instagram. If you contact us on one of our social media platforms, request customer service via social media or otherwise direct us to communicate with you via social media, we may contact you by direct message or use other social media tools to interact with you. In such cases, our communications are governed by this Privacy Policy and the privacy policy of the social media platform you use. In addition, if you choose to communicate with us through a third-party social media platform, you are granting us permission to access and use the information you post or store on the applicable social media platform in accordance with the privacy policy of that platform. We don’t control, and are not responsible for, the privacy practices of third party social media platforms.  You should consult the privacy policy of each such platform for additional information.

Miscellaneous

In the event that any provision of this Privacy Policy conflicts with applicable law, rule, regulation or order or if any provision is held invalid by a court with competent jurisdiction, then such provision will be deemed to be restated to reflect as nearly as possible the original intentions of the parties, and the remainder of this Privacy Policy will remain in full force and effect. Any failure by Leyland to insist upon or enforce strict performance of any provision of the Privacy Policy or to exercise any right under the Privacy Policy will not be construed as a waiver or relinquishment of Leyland’ right to assert or rely upon any such provision or right in that or any other instance, rather, the same will be and remain in full force and effect.
